in oakland. three people were killed in two separate incidents. a double shooting and a stabbing. alex savidge is live on walnut street where a woman was killed a few hours ago. >> this is still an active crime scene for oakland police. what they found here this morning was a woman that was stabbed to death. it's all playing out. the crime scene located inside this apartment building that is up the road here from us on the right hand side. you can see at least one squad car is parked outside. we want to show you video we shot in the last half hour. woman's body was found inside the second floor unit. this all began according to a sergeant when a neighborhood called 911 around 2:30 this morning. officers arrived and found a woman with multiple stab wounds. she eventually died here on scene. police have taken a man into custody who may have been responsible for the killings but at this point the sergeant tells me the motive for this stabbing remains unclear. meantime on the other side of the city oakland police are piecing together a shooting that left two people dead. the gunfire in tha

explained what oakland unified will now have to do as a punishment. >> reporter: for years, this private religious school has received thousands of dollars in federal funds. $50,000 just this year, dolled out by the oakland unified school district. it's the school that sends its students out to bart stations to solicit money. tonight they left after we approached them. a joint cbs 5 california watch investigation earlier this year questioned the district's lack of oversight, allowing inflated enrollments by the school to get the federal funding, and the school's alleged misuse of that money. the california department of education took a closer look and has ordered the district to repay nearly $25,000. tonight, we reached the district spokesman out of spoke. >> we dispute the notion or the finding that we have misappropriately handled funds. >> reporter: we questioned the school's use of federal money to pay his wife and son as teachers. >> the wife gets paid $100 an hour for her duties as a developmental teacher. that sounds a little excessive. >> it does. i'm not aware of their particul

that steady stream of traffic sneaking its way back up westbound. up next a look here at 880 near the oakland coliseum. you can see traffic flowing well in both directions. >>> a man is in the hospital after falling about 30 feet inside the coliseum in last nights raiders game. christien kafton is at the oakland coliseum with the investigation. good morning, christien. >> reporter: i have been texting the sheriffs office trying to find out more about this. here's what we do know during or right before last nights game a fan was on the third deck there. you can see how high that deck is there and either fell or jumped to the lower concourse below. the fan fell an estimated 30-50 feet to land on the concrete below. that fan fell during last nights raiders-broncos game. emt, police, and sheriffs deputies were on scene and able to respond quickly. there are conflicting reports over whether that fan fell or jumped. emergency workers took that fan to highland hospital just 3.5 miles away with serious injuries. his identity has not been released at this point. the raiders have released a statement s

of oakland. the chp says the driver got on to interstate 880 toward oakland after failing to stop for a traffic violation. the chase lasted for several hours before the driver got off the freeway and stopped by spike strips near mountain view cemetery in piedmont. >>> all lanes have reopened on highway 580 in richmond. that is following a fatal accident. the chp says the pedestrian was hit and killed around 8:30 last night on westbound 580. authorities still looking into why the person was walking on the freeway. the big rig driver is cooperating. >>> two hours from now, the supreme court may announce whether it will reveal proposition 8. california's ban on same sex marriages. they met behind closed doors on friday. but prop 8 was not on the list. the court is set to release a number of cases at 6:30 this morning. and if the justices decline to review prop 8 that will let stand an appeals court ruling. same sex marriage could be legal again in california for days. >>> with less than a month to go it appears congress is no closer to keeping a country from going over that cliff. th

. >>> investigators are looking for what sparked a fire this morning at an apartment building in oakland's grand lake neighborhood. flames broke out about 7:40 a.m. at the building of warfield avenue. the third floor of the building suffered the worst damage. everyone got out okay but at least four people had to be treated for smoke inhalation. firefighters put the flames out in about 15 minutes. an estimate of the damage is not yet known. >>> well, it was not saint nick, but a man had to be rescued early this morning, after getting stuck in a chimney. it happened around midnight, at a sixth story apartment building on clay street. that's in a laurel heights neighborhood and firefighters had to use special equipment to get the man out. authorities say they have no idea why the man was in the chimney or how he got stuck. >> when we arrived we found one person inside the area here. and we utilized the rescue squad. utilized some of their special equipment had. to breach some of the bricks. move enough bricks to facilitate getting him out. >> the man was rushed to the hospital. police have not released
